What is a Power of Attorney?

It is the document by which one person legally authorizes another to act on their behalf — to sign, decide or manage matters for them.

The person granting the power is the principal; the one receiving it is the agent (or “attorney-in-fact”). The power can be broad or limited to a single task, and can end on a date, upon incapacity, or when the principal revokes it.

What is a power of attorney?

Do I need a lawyer to create a power of attorney?

What changes depending on the state?

What’s the difference between a general and a durable POA?

A general POA grants broad authority that ends if the principal becomes incapacitated. A durable POA stays in effect even upon incapacity, which is why it’s used for planning.

How is a power of attorney revoked?

With a signed revocation document delivered to the agent and to any institutions where it’s on file. The revocation letter is a separate document and is generated separately.

What language is the document delivered in?

In English. The site and the questionnaire are in Spanish and English: you can answer in Spanish and receive the document in English. We do not know and cannot guarantee that the institution requesting it will accept this document; confirm the language and format it requires before you pay.
